El Soto de Marbella /Club de Golf- Club Social
QUESTIONS RAISED BY THE PRESIDENT OF MARBELLA HILL VIEW IN JANUARY 2016
I was at the restaurant today and enquired at the members desk about the delay in distributing membership cards.
The reply was that this has been held up because some owner has complained about having to pay a 10€ administration fee for entrance cards for
tenants.
There are several points here that I don't understand.
We had a meeting at which we discussed this issue and it was agreed unanimously. I cannot see therefore why anyone can complain. There is
work involved in producing cards for tenants every time a new tenant arrives and someone has to pay for it.
However, there were no minutes issued of that meeting and so the meeting does not have any legal force. We must ensure that in future all
meetings are formally called, constituted and minuted and that formal votes are taken and recorded.
I have read the minutes of the constitution of the Club, the Statutes of El Soto Phase 1, the Statutes of Marbella Hill View, the escritura
of Obra Nueva of Marbella Hill View and some escrituras of owners at Marbella Hill View.
Nowhere in those documents can I find anything which grants membership of the Club to anyone other than owners. Nowhere is membership extended
to tenants or friends and family of owners. Legally in those documents it appears that the only members of the Club are the same people who are
members of the various Communities of Owners. To change these rules it would of course need a unanimous vote.
So I would be grateful if someone could provide me with the legal documents giving free membership to anyone other than apartment owners.
From those same documents I can find nothing that obliges the owners of Marbella Hill View to be part of the El Soto Club de Golf. It does
not appear in the Obra Nueva, nor in the statutes.
So I would be grateful if someone could provide me with the legal documents which oblige the Community of Owners of Marbella Hill View to
participate in the costs of the Club.
Given that the land of the Club is now owned by Ojen Town Hall and that the building itself does not appear to have an escritura proving
ownership by anyone it is difficult to see what the Community of Owners of El Soto Club de Golf actually own.
I would therefore be grateful if someone could provide the necessary legal documents so that I can explain the situation to various owners in
Marbella Hill View who are asking these questions.
